The community property trees in my area were pruned recently, but there are still branches hanging over my yard. Why weren't they removed?
The pruning specifications for most communities require that branches be pruned to a certain distance from structures and fences, but branches may still be hanging over your yard or your house if they are beyond that specified distance. Under Maryland law, homeowners are authorized to remove any branches that encroach on their property at the property line, if they so choose.
I am worried, because the tree behind my house is tall and leaning. Can I request that it be removed?
Trees lean for a variety of reasons, and a leaning tree can be very healthy. In cases like the one you describe, we request a tree expert to inspect the tree and the area to confirm whether or not the tree is dead, diseased or is an imminent hazard. If it is determined to be in an unhealthy state, the community's Maintenance Committee and/or board of directors may direct that the tree should be removed. We should point out, too, that healthy trees can fall over if weather conditions are unfavorable. The Maintenance Committee follows up on each resident concern and determines whether the tree should be removed. |
