Selling your property in Montgomery Village? You will need to arrange to obtain a "Disclosure Packet" to provide to your prospective buyer. Until now, resale disclosure packets from Montgomery Village Foundation (MVF) have only been available in a hard copy notebook format. Now you may choose to order your resale disclosure packet in a CD format—everything is included!
What is a "Disclosure Packet?"
The Disclosure Packet contains information about the Montgomery Village Foundation and your local homes corporation* or condominium association.
Why do I need a Disclosure Packet?
It's the law. The Maryland Homeowners' Association Act, enacted in 1987, requires a seller of property located in a homeowners' association to provide the buyer with certain information about the association. This assures that the buyer is aware of the fees, rules and regulations, and other important information about the association.
What is included in the Packet?
Information about the Montgomery Village Foundation including:
• MVF legal documents: Articles of Incorporation and By-laws;
• MVF Annual Report/Budget information;
• Residents Guide—which includes a description of MVF facilities and services, homes corporation and condominium association info, an overview of rules and policies; community rules and regulations, as well as community architectural standards and criteria;
• Assessment Collection Policy;
• Dispute Resolution Policy.
Homes Corporation/Condominium Association Information* including:
• A certificate that contains the following information:
• A statement of the annual Montgomery Village Foundation and Homes Corporation/Condominium Association* assessments for the current year and previous year;
• A statement regarding the current assessment status of the property;
• A statement noting any unsatisfied judgments or pending lawsuits;
• A statement noting any architectural violations, covenant violations, and the nature of those violations. Foundation staff will inspect the exterior of your property to ensure compliance with community standards.
How do I obtain a Disclosure Packet?
There are several ways in which you or your realtor may request a disclosure packet:

There is an upfront administrative charge of $175* ($150 for South Village and Northgate) to cover the cost of packet preparation and materials, as well as property inspection. This fee is the same whether you wish to receive the hard copy only or the CD only; there is an additional $25 fee if you wish to receive both the hard copy and the CD.
Online forms must be printed and submitted by mail or faxed to the MVF Office along with the applicable fee (the fax number above and on the form is a secure line for submittal of credit card information). Staff will begin processing the packet upon receipt of the application and fee. Note: There is a "rush" fee of $200 for a five working day turn-around of any disclosure packet.

As a service to Village homeowners, MVF will prepare the packet for you that contains all the information and materials needed in order to comply with the law—and more—plus conduct the research necessary to determine the status of assessments and the architectural record of the property.
(*Note: South Village and Northgate residents must request an additional disclosure packet from their management company—see below.)
How quickly can the Foundation prepare the Packet?
Packets can generally be prepared within seven to ten working days. Scheduling of the architectural inspection, particularly during inclement weather, can delay packet preparation; however, every effort is made to conduct the inspection and prepare the paperwork in a timely fashion. We understand the stress and timetables involved in home sales contracts!
While there are other commercial companies that advertise the preparation of disclosure packets, no private company is able to provide disclosure packets more promptly than the Foundation. Commercial companies must rely on MVF to do the research for the assessment and architectural information on any Village property and then return the information to them.
